DOJ Racial quota scandal: another Eric Holder headache

Judicial Watch uncovered hundreds of documents from the City of Dayton, Ohio, showing that Department of Justice (DOJ) officials pressured the Dayton Police and Fire Departments to lower testing standards because not enough African-American candidates passed the written exam. On May 25, Judicial Watch also filed a lawsuit against the DOJ to obtain additional records related to the Dayton program after the DOJ failed to respond to a Judicial Watch Freedom of Information Act (FOIA) request (Judicial Watch v. U.S. Department of Justice (No. 11-971)).
Here’s how messed up the situation has gotten at the Obama DOJ when it comes to racial discrimination.  As you may recall, the DOJ abandoned its own lawsuit against members of the radical New Black Panther Party who threatened and intimidated white voters on Election Day 2008.  (The leftist NAACP appears to have helped call the shots on the case dismissal.)

Legal thugs, wasting your (tax) money: FDA seizes entrepeneur's portable hot tubs

My wife is doctor-phobic and needle-phobic.  While we are conservative both socially and religiously, we ended up with a very "earthy-crunchy" solution for each of my three kid's births.  

My oldest was born in a freestanding birthing center (5 minutes from a hospital).  After I talked myself into a comfort level with the idea, our two girls were born at home.  My wife was attended by a midwife (who has OB backup), and a doula.  We used portable 5 foot diameter heated (96 degrees) birthing tubs we rented from waterbirth.org.  The woman who runs the organization, Barbara Harper, became friendly with my wife during that time, and they still keep in touch.  Recently, Barbara posted the following on her facebook page.

Okay, here is a big problem that has been lurking for a few months. The FDA has seized all the portable birth pools that are currently imported and are threatening to destroy them. They claim they are unregistered medical equipment, but they are not providing a way or means to get them registered. In other words, if the medical authorities can't stop waterbirth, then just have the FDA take away the birth pools. This IS SERIOUS my dear ones!!! VERY SERIOUS!!!


I'll write more very soon. But, put on your thinking caps. Yes, lawyers and business advisors are involved. My first run in with the FDA was in 2000.


Just think, they might knock on your door and seize your bath tub!!!

FDA releases tubs, but needs further assistance with education

This just in from Waterbirth Solutions......


The FDA called to notify me that they were releasing our Aquaborn inventory that has been on "Retention" for two months, as well as all future inflatable birth pools.


At this time, they are still reviewing birth pools, but they are NOT classifying them as Medical Devices.


The vendors involved were fully prepared to argue strenuously against Medical Device classification and at this time it appears this does not need to be done.  Basic argument is that we are selling a vessel and that the WATER is what provides the benefit to the woman.


They asked me for information about how to collect data from the vendors involved to further their understanding of waterbirth.  I suggested they contact ACNM, MANA etc., professional organizations.  I said the natural birth community would be happy to engage in a fact-based, open discussion about waterbirth.  I suggested that all views be considered as long as they had data to back up their claim.  As in, ACOG has no data to support their position on waterbirth.


This is fantastic news and I wanted to share it asap!

As I was considering writing this post, I came across an article from Harvard Law School from 2002, written in regard to the power of the Food and Drug Administration's power to confiscate.  


It concludes thus:



V. Conclusion
The system may be described as bent but not broken. The seizure power is not wielded constantly, although it may dangle over the heads of some owners like the sword of Damocles. Although the system functions adequately, it could be made to work better. The issuing of warrants on less than probable cause, coupled with post-seizure hearings and a limited right of recompense, although all small potatoes in their own right, together can amount to a genuine burden on the affected property owner 

Seizure is a weapon: “Some litigators believe that if there is an advantage to be taken, it should be taken. Whatever the propriety of that view in ordinary civil litigation between private parties, it is to be hoped that governmental agencies such as the FDA would take a different approach.”221    

It would not tax FDA or judicial resources too greatly to consider the rights of the wrongly accused owner, or the potentially wrongly accused, a little more carefully. --link

My point in posting what you might consider a minor matter:
The arbitrary and brutal nature of government is power; power asserted.   


Sometimes government force is wielded against genuine criminals, sometimes it is wielded against the innocent.


Sometimes against "criminals" that commit no actual crime against persons or their property, but have violated a law passed to assert government control over an industry--such is the case here.  


In Barbara's case, she is a private individual, an entrepeneur, and a passionate woman who's goal is to make a woman's birth process wonderful and memorable.  


Because the birthing pools were held for two months, Mrs. Harper lost the income of the rentals, and lost income in hiring attorneys, not being able to focus on her clients, etc.,.  


Why did she lose all of this time and money?  


Over bullsh*t arbitrary rules that are meant to assert control, not to protect the public.  In other words, this is good example of a betrayal of the mandate of the law--to protect people's lives and their property.  That is the only reason to have a government.


   This incident shows government for what it actually is:  the guys with the most guns, "a gang of thieves writ large", the largest protection racket around, you get the point.  Protecting the public interest has become (or has always been, what do I really know?) the window dressing to legitimize their existence, not the reality on the ground.


Here is your tax money at work:  the FDA spends the man-hours paying their agents to investigate, raid, confiscate and store portable HOT TUBS, alleging that they are unregistered "medical devices".


The FDA agent in charge of this effort either is stupid or disingenuous...either way, not good for us, the public.  


Either he doesn't know a lick about giving natural childbirth in a pool of warm water (can also be done in a hot spring or an oversize bathtub;  is a hot spring an unregistered medical device?  It is the buoyancy of the water and the warmth of the water that takes the edge off of labor, not the tub), or is trying to extort money from this business owner, is trying to crush her business in particular, or is part of an ongoing and broad organized medicine/government collusion against non-physician medical practitioners (e.g. midwives).


So here it is again: (By definition -- Legal) thuggery and theft of private property on a small scale.


If they can do it using the FDA to Barbara Harper, what will stop them from doing it to you or your employer under some other agency or pretext?  How much of your tax money is wasted in this manner?


It was supposed to be the Bill of Rights and Constitutional limits on governmental power to protect us, but less and less and less since the sad conclusion of the War of Northern Aggression.

Evidence supporting the assertion that New Yorkers are retards


More than half of U.S. Representative Anthony Weiner’s constituents want him to stay in office even though the married lawmaker has admitted sending inappropriate photos and messages to women he met online, according to a poll released today.
A survey by the Marist College Institute for Public Opinion and NY1, a New York City television news station, found that 56 percent of registered voters in Weiner’s district say he shouldn’t resign, while 33 percent want him to quit.
Weiner has been one of the Democrats’ leading voices attacking Republican positions on health care, with camera-ready sound bites that garnered as many as 1 million hits on YouTube. Registered voters in Weiner’s district are divided on how effective he can be if he remains in office, with 48 percent saying he can continue to be effective and 43 percent saying they don’t believe he can.

STOCKTON, CA - Kenneth Wright does not have a criminal record and he had no reason to believe a S.W.A.T team would be breaking down his door at 6 a.m. on Tuesday.
"I look out of my window and I see 15 police officers," Wright said.
Wright came downstairs in his boxer shorts as a S.W.A.T team barged through his front door. Wright said an officer grabbed him by the neck and led him outside on his front lawn.
"He had his knee on my back and I had no idea why they were there," Wright said.
According to Wright, officers also woke his three young children ages 3, 7, and 11 and put them in a Stockton police patrol car with him. Officers then searched his house.
As it turned out, the person law enforcement was looking for was not there - Wright's estranged wife.
"They put me in handcuffs in that hot patrol car for six hours, traumatizing my kids," Wright said.

This, it was explained to me, is necessitated by the continuing stonewall of the Obama administration. "They're going to go with with they've got or they'll be waiting for documents until Hell freezes over. They've figured out what the rest of us knew all along -- that the only way to break the cover-up is under oath."

As described by the sources close to the investigation, Phase I will be "the presentation of allegations and factual information, evidence, and intended direction of the continuing investigation." This will include documents already presented to Senaqtor Grassley and Congressman Issa by whistleblower ATF agents. Senator Grassley will be among the first witnesses before Issa’s panel. Family members of Project Gunwalker victims are expected to testify, as well as other witnesses with first-hand knowledge of the conspiracy whose knowledge runs from Arizona to DC.

Phase II, according to my sources, "will focus on Mexico issues with witnesses called who have first hand Mexico information."

Phase III will be when it really gets interesting, when all the big names in ATF and DOJ complicit in this scandal who have been uncovered in the previous two phases are called to explain themselves. One source characterized this as "the testimony of compromised participants to include the numerous ATF and DOJ employees with dirt, blood or both on their hands."

"After Phase III is done, the next step will be a Special Prosecutor with broad powers to get at the rest of the truth and proffer charges against some of the highest officials in the land," said another source. "Eric Holder is toast," he added. "If he stays out of federal prison, I'll be surprised."

No longer the freest country in the world, not by a longshot.

"I was in such a hurry to make my flight that, when going through security, I forgot to empty my pockets. I know, the cardinal sin, right?

I had a Blackberry, my wallet, a belt, and several Chilean coins jingling around in my pants, and the X-ray machine dinged like a winning slot machine.  Instinctively, I prepared myself for a verbal battle with some neanderthal who would try and put his hand down my pants. Except… it didn’t happen.

In my haste, I had almost forgotten that this was Chile, a civilized place that doesn’t go out of its way to demean citizens and residents at every available opportunity. No fondling, no fear and intimidation tactics, no surprise searches, no cash-sniffing dogs, no ‘secondary screening’, no stasi on the jet bridge.

Instead, the solo security attendant simply asked if I had anything in my pockets. I pulled out my Blackberry and showed it to him, and he waved me through. I was on my plane 2-minutes later.

A few days ago, I was having a conversation with our Chief Investment Strategist Tim Staermose; he was telling me about a similar experience traveling recently to Macau via hydrofoil from Hong Kong.

During his trip, he checked his luggage, got his boarding pass, went through immigration control… all the typical sort of international travel stuff, except for one thing: there were no X-ray machines or radiating body scanners at all, and there certainly weren’t any surly border guards to fondle passengers.

As I travel frequently and spend time in so many different countries, it’s becoming clear to me that there are essentially two categories in the world– police states that are running towards George Orwell’s view of the world in 1984, and countries where you can still feel like a free human being."

The hacker collective Anonymous Operations may not be the most organized but they sure are passionate. Following the latest disinformation campaign of a Greek bailout, the hackers, which had previously expressed their solidarity with the Greek people (see below) have no made it clear that the latest target of their wrath (which a few months ago was the Federal Reserve) is now the IMF. Or at least its website. As of a few minutes ago, "Anonymous" tweeted that the target of its imminent DDOS attack will be www.imf.org. Alas, since the IMF has always been merely a figurehead for global bailout efforts, in this particular case spearheaded by various banking interests, we give Anonymous a few days before they realize that the target of their "anti oppression" move has a website with a .com suffix, not .org. And regardless of how (in)effective this action is, at least it sends the message that someone is willing to do something to at least protests against the rape that will soon occur in Greece, hidden by the very polite word: "privatization."

For those that claim that it is unreasonable or unlawful for a citizen to resist a no knock warrant with deadly force, I disagree to the depth of my soul.  


I would prefer to go down like Jose Guerena than to submit to this kind of violation, and live with the guilt of not resisting to my utmost.  


If you aren't willing to die defending yourelf, your property, your wife and kids, what are you willing to fight for?  

What red line are we waiting for them to cross?

So many violations of our natural and Constitutional rights.  So few all at once, or concentrated against a large population, only in dribs and drabs.

More important question is similar to the one the government faces with al-Qaida--how do you fight an enemy that you cannot see? How do you fight an enemy that fights you with legal plunder, or legally legitimized (that's redundant, I know) violations of our rights? 

At the moment, I have no idea, but I think about it all the time.

In a TV slip caught by Al Jazeera, yet another Zero Hedge prediction has been confirmed: namely that it was only a matter of time before NATO "boots on the ground" would promptly replace the CIA's "sandals on the ground" in a fully Western-backed land invastion of Libya. Since it is too early to predict the nationality of the armed invaders, we will assume they are British as Al Jazeera speculates, because otherwise Congress is about to find itself in an unprecedented scandal for completely ignoring its duty to impose the War Powers Act, which in turn would mean that the President now has a unilateral right to enforce the invasion of any country he so chooses. We will leave the bitter implications of what this could mean, as America celebrates, and remembers the lives of so many who died for this once great country, to others.

The Pledge of Allegiance: Say it and come get your ritalin and prozac

Francis Bellamy (1855-1931).  Born and raised in western NY, same as me.  What we have in common ends there. 

Bellamy was a Christian utopian socialist, who believed in redistribution of wealth to accomplish justice.  A Marxist who hadn't lost religion.  He was one who believed that to accomplish a utopian United States, it would have to begin with the children. The Pledge he wrote as part of the 400th anniversary of Colombus' arrival in the Americas, was also coincident with the movement to have an American flag in every American  school. 

This happened 27 years after Appomattox; the memory of disunion was fresh in the Collective memory of the Nation.

In 1954, in response to the perceived threat of secular Communism, President Eisenhower encouraged Congress to add the words "under God," creating the 31-word pledge that is recited today.[3]


Bellamy commented on his thoughts as he created the pledge, and his reasons for choosing the careful wording:
"It began as an intensive communing with salient points of our national history, from the Declaration of Independence onwards; with the makings of the Constitution... with the meaning [ha!] of the Civil War; with the aspiration of the people...
"The true reason for allegiance to the Flag is the  'republic (sic) which it stands'. ...And what does that last thing, the Republic mean? It is the concise political word for the Nation (Sorry, Bellamy, old man, but involuntary "Nation" post 1865, and voluntary 1776 "Republic" [when the Bill of Rights still meant something] are antithetical) - the One Nation which the Civil War was fought to prove (prove with a bayonet, you mean. Oh, I see the point of your argument. You must be right. My bad.). To make that One Nation idea clear, we must specify that it is indivisible, as Webster and Lincoln used to repeat in their great speeches (no comment...Bellamy was 10 years old in 1865.  He knew no other religion than post War Lincoln cultism). And its future?
"Just here arose the temptation of the historic slogan of the French Revolution which meant so much to Jefferson and his friends, 'Liberty, equality, fraternity'. No, that would be too fanciful, too many thousands of years off in realization. But we as a nation do stand square on the doctrine of liberty and justice for all..." (and now we all know how that ended up--liberty for none, leniency for the well connected)
Bellamy "viewed his Pledge as an 'inoculation' that would protect immigrants and native-born but insufficiently patriotic Americans from the 'virus' of radicalism and subversion."[4] (come to think of it, I feel a little sick to my stomach now)

Denninger puts Memorial Day in perspective

Our forefathers primarily went to war with Britain over two issues: Taxation Without Representation and Writs of Assistance.  While we're at it we'll add Equal Protection Under The Law.

The former everyone understands: The extraction of taxes from the people without any right to direct where the funds go. 

How are we doing today?

Some half of the population pays no Federal Tax.  They receive funds, net-net.  Since it is now quite possible to "vote for a living", that's exactly what has happened.  But this means that for each and every person who pays taxes on net, you no longer have representation.

How about the latter?

Well, we have the following:
  • Searches on I-40 in Tennessee; these have been clearly identified (and admitted!) through media investigation to be effectively stopping drivers for profit.  Where's the probable cause to search a traffic stop's vehicle for money and then declare it "drug proceeds" simply due to which direction the vehicle is traveling on I-40?  In this case the police aren't even bothering with the formality of getting the Writ of Assistance - they're simply stealing the funds.
  • Kicking down doors in Kentucky.  Yes, the cops were chasing a person who allegedly sold crack cocaine.  But we're then supposed to believe that seconds after this person ran into one of two apartments - being actively chased by the police - the suspect lit up a joint?  (The rationale for the cops kicking down the door was that they smelled marijuana, and upon knocking heard "movement" and believed the occupants might be "destroying evidence.")  That conviction was upheld in the United States Supreme Court - even though the person they were looking for wasn't in the apartment.
